“Regulatory Rug Pulled From Under Companies’ Feet.” The U.S. Environmental Protection Agency (EPA) has the power to retroactively withdraw permits, even those issued by other agencies with EPA approval, according to Tuesday’s decision in Mingo Logan Coal Company v. EPA. The U.S. Court of Appeals for the D.C. Circuit, Tuesday, April 23 also announced there is no time limitation for appeals, and the EPA Administrator may withdraw permits whenever he or she feels an “unacceptable adverse effect” will result.
